Superior SMSF Solutions Pty Ltd (ABN 61 698 472 436) ("we", "our", "us") is a Registered Tax Agent providing self-managed superannuation fund (SMSF) administration, compliance and related services to Australian trustees, accountants and advisers.

We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.

What personal information do we collect?
Personal information includes information or an opinion about an individual who is reasonably identifiable. We may collect the following types of personal information:
- Name and title;
- Residential, postal or street address;
- Email address;
- Telephone number and other contact details;
- Age, date of birth and place of birth;
- Tax file number (TFN), Australian Business Number (ABN) and director identification number;
- Bank account and financial details relevant to your fund;
- Credit card information;
- Details or images of your government-issued identification, such as your passport or driver's licence, where required for identity verification;
- Superannuation and financial information, including fund balances, contributions, investments and member, trustee and director details;
- Details of your accountant, financial adviser or other authorised representatives;
- Your device type, geo-location, IP address and standard web log information when you use our website;
- Ad data, including statistics on page views and traffic to and from our website;
- Details of the services we have provided to you or that you have enquired about, including information necessary to deliver those services and respond to your enquiries;
- Information you provide to us through enquiry forms, onboarding applications, correspondence, customer surveys, or when joining a waitlist or registering your interest in future products or services; and
- Any other personal information that may be required to facilitate your dealings with us.
We may collect these types of personal information either directly from you, or from third parties. We may collect this information when you:
- Onboard on our website;
- Communicate with us through correspondence, email, or when you share information with us from other social applications, services or websites;
- Interact with our sites, services, content and advertising.
Additionally, in certain circumstances we may collect sensitive personal information from you, such as biometric information. When we collect sensitive personal information, we will ask for your express consent.
Collecting your information
By law, we can only collect information that is reasonably necessary to provide our services. Where you provide your information, you indicate that you are happy for us to use your personal information where lawful and necessary, and that you are authorised to provide it.
We collect personal information directly from you when you complete our enquiry or onboarding forms, engage our services, subscribe to our updates, or contact us in person, online or over the phone. We may also collect personal information from third parties — such as your accountant or financial adviser, the Australian Taxation Office (ATO), or identity verification providers — to supplement our records, detect fraud, and comply with our regulatory and legal obligations.
Why do we collect, use and disclose your personal information?
We may collect, hold, use and disclose your personal information for the following purposes:
- To establish and administer your SMSF, including preparing financial statements, member statements and SMSF annual returns;
- To arrange the independent audit of your fund and lodge documents with the ATO and other agencies;
- To verify your identity, including for the purposes of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) where applicable;
- To provide, operate, protect and improve our services and your experience with us;
- To send you service, support and administrative messages, reminders, notices and information you have requested;
- To send you updates and information that may be of interest to you, where you have opted in to receive them;
- To comply with our legal, taxation and regulatory obligations, and to resolve disputes; and
- To consider any employment application you make to us.
Do we use your personal information for direct marketing?
From time to time we may send you communications and information about our services that we think may be of interest to you. This may take the form of emails, SMS, telephone calls, mail or other forms of communication. You may opt out of receiving marketing communications from us at any time by contacting us using the details set out below, or by using the unsubscribe facility provided in our communications. Communications relating to the administration of your fund are service-related and are not marketing communications.
To whom do we disclose your personal information?
We may disclose personal information for the purposes described in this Privacy Policy to:
- Our employees and related entities;
- The Australian Taxation Office (ATO) and the Australian Securities and Investments Commission (ASIC);
- Independent, ASIC-registered SMSF auditors engaged for your fund;
- Our cloud-based SMSF administration software provider (Class Super) and other secure IT and data-storage service providers;
- Identity verification providers, where required by law;
- Your nominated accountant, financial adviser or other authorised representatives;
- Our professional advisers and business partners;
- Anyone to whom our assets or business (or any part of them) may be transferred;
- Specific third parties authorised by you to receive information held by us; and
- Government agencies, regulatory bodies and law enforcement agencies, or as otherwise required, authorised or permitted by law.
We do not sell your personal information, and we do not disclose it so that third parties can market their products to you.
Disclosure of personal information internationally
Some of our service providers may store or process data on servers located outside Australia. Where we disclose your personal information to overseas recipients, our approach is to take reasonable steps to ensure those recipients handle your information consistently with the Australian Privacy Principles. We only provide service providers with the personal information that is reasonably required for them to perform their services.
Our Cookie Policy
Cookies are small text files that store information on your device when you interact with online content. We may use cookies to help our website function, to understand how visitors use it (such as which pages you visit and the time and date of your visit), and to improve your experience. While we do not use this browsing information to identify you personally, you can elect to disable all or certain cookies through your browser settings — although some parts of our website may not work as intended if you do.
Security & storage of information
We may hold your personal information in either electronic or hard-copy form, including with third-party data-storage providers and within our SMSF administration software. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure, using a range of physical, administrative and technical measures. However, no method of transmission or storage is completely secure, and we cannot guarantee the absolute security of your personal information.
Length of storage
By law, we need to store information about you for at least 7 years. In many cases it may be longer for some SMSF records.
Ordinarily, we will not hold your personal information for more than this period after our relationship with you has ceased, unless required by law or due to an ongoing claim.
If you join a waitlist or register interest in a product or service that is not currently available, we will retain your personal information only for so long as is reasonably necessary to manage the waitlist, communicate with you about the availability of the relevant product or service, and comply with our legal and regulatory obligations. If you request removal from the waitlist, or if the relevant product or service does not proceed within a reasonable period, we will take reasonable steps to delete or de-identify your personal information unless we are required or permitted by law to retain it.

Making a privacy complaint
If you believe we have breached any of the Australian Privacy Principles, or you wish to make a complaint about the way we have handled your personal information, please contact us using the details below. Please include your name, email address and/or telephone number and clearly describe your complaint. For security reasons, we may ask you for proof of your identity. We will acknowledge your complaint and respond within a reasonable period of time (usually within 30 days).
